Great relief for Mark Pendlebury. Does he face charges of carrying a deadly weapon in public? If not, why not? And is it now ok to carry 'a deadly weapon' in public?

Editor Comment:

He continues to face the deadly weapon charge. The other charges have yet to be formally dropped by the Prosecutor, which is why PW, which first revealed the discrepancy in the witnesses' accounts, has yet to report the conclusion of the case.

Very good news about Mark Pendlebury.

It is a credit to Phuketwan that its reporting of this incident was based on evidence and facts rather than on some initial dodgy reports.

I read gee's comment and your reply. I shall watch this space.

Indeed. All credit for disclosing what really happened goes to Chutima Sidasathian. She obtained the video and we published it. Great work on her part.

I wonder whether the Phuket news outlet who reported "Thai man murdered by expat" will feel bad. I doubt it. PW, as usual, got it right from the start.

Well done Khun Chutima and congratulations to the person who hired you too. Good choice.

So will the police be filing assault charges against the tuk-tuk drivers for their attack on the gentleman?

Prime Minister Prayuth Chan-o-cha has discovered the "hot water"... Phuket has already a lot of ponds, but the problems is that many are going to fill and the others are in many case polluted by the people living (illegaly) in the hill behind. The ponds on left and right side ofe the shortcut betwenn Chao Fa and Katu are a clear sample what I'm speaking about

'Cleared' but still paid a heck of a whack in compensation.

@gee, you really are pedantic fool, focusing on the knife rather than the fact this guy was possibly fighting for his life, against multiple attackers. I wonder what you would have done? It's interesting you having asked what charges are to be laid against the other attackers, I for one would consider their actions more "illegal" than someone carrying a knife, initially with no intent to use it.

It is such a great job that has been done by Khun Chutima to find and get in hands CCTV recordings of the incident - I guess it required not only a lot of efforts to find and negotiate access to a recording , but also quite courage;

and not only for the purpose of quality reporting on the case, but also contributing to a good cause of upholding justice - even more karma-positive as the case relates to the person who , as it has been reported here, is well known for the same approach, but this time he himself fallen into troubles and needed an assistance in this situation.

One more time on carrying knives in public:

There is no blanco ban on carrying knives:

Penal Code
Section 371
Whoever, carries arms in a town, village or public way openly or without a reasonable cause, or carries arms in a gathering assembled for worship, entertainment or any other purpose, shall be punished with fine not exceeding one hundred Baht, and the Court, shall have the power to forfeit such arms.

Evaluation whether carrying a knife was justified is done on case-by case manner and is at discretion of law enforcement officers. Some of interpretations are that Swiss knife for a woman traveling alone in a car is a reasonable cause, but if in company of three persons in a car, then not, and is punishable offence.

I read at another media outlet that MP has been fined for carrying the knife. Obviously, these legal proceeding were separated from the main proceeding, that is very strange.

Giving that the knife apparently saved his life , no doubts , at least in hindsight, that his carrying of the knife was "reasonable".

I don't know whether he still can appeal that fine, but it seems to be important to exonerate himself from those charges, as otherwise this fact of illegal carrying of the knife can back fire on civil likability side.

Alleged paying of compensation - it is of course up to MP to decide whether to go for compromise or maintains very strict line. Actually, it seems that he initiated deal on compensation before the evidence has been uncovered and presented to investigators, so he may manage already to sign all papers - and pacts sund servanda - he will have to follow what he has obliged himself by his signature.

Sue,
Just out of interest do you prefer the left or right attire?

Manowar,

I am not a fun of decorating interiors with deer horns, but if I had to, I would put both, not just the left or the right part of an attire.

Lots of people carry a pocket knife if used in their occupation all the time
I did for many years, a Swiss army knife is a multi use tool, its just something you put back in your pocket like change or car keys
