Julian Burnside AO QC backs Phuketwan.

One of the very best known and most respected Australian human rights lawyers is speaking up very publicly in support of Phuketwan journalists.

Yesterday he was sending out tweets with a link to a one page story on his own website, which had further links to a recent ABC documentary on the Rohingya featuring Alan and Khun Chutima and the Phuketwan story of 17 July 2013.

Think the uniform idea will be a bit of a mess at larger destinations with lots of different groups seen in pattaya recently there's a limit on how many different types of flags guides can carry some even using stuffed toys

Exactly what my girlfriend said about copy shirts.
Will also be harder to identify what company the guides are working for.I can see a lot of people getting on wrong buses. Will be funny as well seeing all the guides on kayak trips
Also there's no different shirts to show difference between tour guide and tour leader.

I sincerely hope that "Phuketwan" manages to survive the looming court action, but it troubles me greatly to see self promoting opportunists like Burnside attach themselves to the cause, Burnside could only be "respected" by those who are unaware of his past when representing the disgraced Alan Bond in trials that accused him (and found him guilty) of defrauding many small investors. Burnside still defends Bond as "good company", yeh right, until your back was turned..!

Lawyers are advocates by trade for causes they don't necessarily personally support. It would be a mistake to blame Bond's lawyer for the man's sins. His writings on human rights are influential and usually spot-on, and rogues usually do make ''good company.'' We're delighted JB sees the injustice that is about to be committed by the headstrong Royal Thai Navy. Phuketwan's survival is now clearly in question.

Dear Lenny

I read your comment with considerable interest. I have to confess that I do find some of your sentiments very reasonable too.

I find criminal conduct and fraud distasteful to put it very mildly. I might make exceptions for the defiance of unjust laws but those are exceptions.

A couple of decades ago I uncovered a series of fraudulent activity that was visited upon a group of investors. When I brought this the attention of the investors I was predictably threatened with civil defamation actions. The threats turned out to be nothing but threats, bluff and bluster but it explains, in part, one of the reasons I have spoken up for Phuketwan in relation to these much more serious criminal defamation charges.

I wish to point out that barristers who practice at an independent bar typically have professional conduct rules that apply to them. Often they are obliged to accept instructions in areas where they have expertise if they are available. One should never assume that barristers approve of the conduct of the people they represent - even if those people are charming or good company.

Julian Burnside gives up a tremendous amount of his valuable time to defend the human rights of disadvantaged people. It costs him a fortune.

I certainly would not describe Mr Burnside as a self promoting opportunist. He does however, promote the causes of people who are vulnerable and he does so at huge personal cost.

I would invite you to go into Youtube and view some of the video clips in which he is featured. There is a great deal of other material about him that can be viewed on the internet too.

Lenny, if ever you needed someone to speak up to protect your human rights you would be well served by someone of his character and ability.

Alan Bond died here in Perth very recently. I do not recall anyone criticising any of the doctors or nurses or ambulance drivers who cared for him.

Some of the medical professionals might perform some pro bono work. Many will not. Julian Burnside performs a huge amount of pro bono work.

Who a lawyer represents has nothing to do with how they should be considered or respected by the public.
Lawyers are subjects of the court and have obligations, not only to the courts but to provide their clients with the best legal representation, whether guilty or not.
A good lawyer is able to present an interpretation of the law to obtain the best result or judgement for his client no matter who it is.

The reason why some people go into law rather than the respectable profession of journalism is that in the law, respect usually comes with experience. Old journalists have to make do with self-respect.

Years ago, British journalist Auberon Waugh had this to say: ''Generally speaking, the best people nowadays go into journalism, the second best into business, the rubbish into politics and the s---s into law.'' Of course, he couldn't have been serious. Not all lawyers are classy.

Oh yes. Uniforms should take care of all of the problems. I wonder if anyone has considered checking the driver's qualifications, as it seems to me that tour buses (along with water trucks) are some of the worst drivers on the roads, and that's not an easy distinction in Phuket:)

Unfortunately, human beings have at times been guilty if seriously misallocating human resources.

The very smartest have often been among the people who invent the worst weapons.

There is not a lot of emphasis on peace studies and tolerance in primary school and high school. Kindergarten kids get the most relevant education on how to behave.

Solving problems in Thailand is often confined to appearances only. If it looks good, it's good enough. Substance is irrelevant.

You may notice how impact on the "Image" is the main concern when negative issues or problems are discussed. Thus the solutions are often equally superficial and useless.

Nevertheless in the minds of local officials when they can make things appear better, they have solved the problem.

I appreciate the measured responses to my previous post. Of course everyone is entitled to representation whatever their crimes, but have a read of Paul Barry's unauthorised biography on Bond, digest the "defense" that was run by Burnside on behalf of Bond, and see if you can swallow your indignation, I couldn't..
And not a "self promoting opportunist"? How many barristers have their own website and twitter account? And why was a Melbourne barrister who specialised in commercial law acting for a Perth based businessman on fraud charges? If it wasn't opportunism then what, money?
I've exchanged emails with Burnside and listened to him speak at the Melbourne writers festival, whilst he has given invaluable oxygen to the plight of refugees, and performed pro-bono, I cannot overcome my own cynicism and continue to view him with suspicion, but I guess narcissism isn't a crime.. I'll get my coat!

Cynicism is not a crime either but your judgements of the reasons for Burnside setting up a self-named site are probably way wide of the mark. Lawyers of his standing - like Geoffrey Robertson, who is another example of a top-flight barrister with a broader sense of injustice - don't need the publicity or the money. Applying your own sense of what motivates people could be a problem. In my experience, lawyers can be difficult to understand at times but the ones with a good heart are good for the right reasons. We believe Burnside's heart is in the right place. He doesn't strike us as a big-noter. Better to be sceptical than cynical.

I was a contracted consultant to a Bond Corp (Iwak) controlled company in Sydney for a number of years prior to and present when the receivers walked in the door and also for a few years after.
The 80's and early 90's were an interesting time and while Bond took advantage of certain companies, especially Bell Resources, many other companies engaged in the same type of aggressive takeovers and 'redistribution' of a companies wealth.
Bond's downfall was most aquisitions were funded by debt and rising interest rates and by upsetting a few people in high places, the downfall commenced.

Bond Corp was typical of a company of this time where rapid expansion meant a certain lack of accountability but there were many people who made a fortune off Alan Bond's back.

I read your comments with considerable interest and just for the record Paul Barry seems to me to be a very thorough investigative journalist.

In answer to one of your questions about barristers and twitter accounts, I can say that it seems like a great many human rights lawyers use twitter accounts to promote stories and discussion.

Here in Perth, Gregory McIntyre SC uses a twitter account. In Melbourne, Jane Dixon QC (immediate past president of Liberty Victoria) uses twitter. Prof Catherine Morris of Lawyers' Rights Watch Canada uses twitter. In London, Geoffrey Robertson QC uses twitter ( he is originally from Sydney). These are just a few of very many.

If one looks at Julian Burnside's website it is very clear that it is dominated by human rights issues with a section dedicated to the arts.

Julian Burnside does have a high profile but he uses that profile and his platform to champion the causes of many vulnerable people. Wealthy corporate clients will not seek his services because he has a nice human rights website or 75,000 followers on twitter. They are much more sophisticated than that.

By the way, about 15 years ago I was having a coffee with a top Perth barrister who mentioned to me in passing that in his view one of Alan Bond's weaknesses was a tendency to ignore the legal advice that was given to him.

Interesting, thanks Ian. I heard on the weekend that Bond at one stage was contemplating a bid for the ABC. That means a sharper Australian government could have sold it and bought it back later at a far lower price, doesn't it? These days, of course, the Government values the ABC too highly to ever sell it off . . .

I see that you have quite a sense of humour when it comes to the ABC (Australian Broadcasting Corporation) and the present Australian government.

Getting back to Lenny, I did observe that he has refrained from criticising any ambulance drivers, nurses or doctors who cared for Alan Bond.

I also note that Julian Burnside practices in four Australian States. Many Sydney and Melbourne barristers represent Perth based clients. There is nothing unusual about that.

I also note that it is the Victorian Bar website that carries the really relevant information on its members' expertise and experience. Julian Burnside's website promotes human rights and the arts.
