Phuket Property Probe: Investigators Turned Away, Frenchman Meets Park Chief

PHUKET: Investigators probing suspected encroachment of national park land on Phuket were turned away today when they tried to enter a property where a resort is being constructed at Nai Thon, on Phuket's west coast.

The team from the Department of National Parks, Wildlife and Plant Conservation were told the land was private property.

Efforts were being made this afternoon to obtain the necessary paperwork from Phuket Provincial Court so the investigating team could enter and survey the land on which the Pullman Phuket Arcadia Nai Thon Beach Resort is being built.

The probe into the legality of 12 properties bordering Phuket's Sirinath National Park is being headed by Damrong ''The Demolisher'' Pidech, Director General of the department, who has 120 staff from other parts of Thailand working on the investigation.

The new director of Sirinath National Park, Cheewapab Cheewatam, said today: ''This is the first time in the history of Thailand that we've carried out this kind of project.

''The top 10 surveyors in the country are now involved.''

Detailed checks are now being made involving resurveying of the land in dispute to establish clearly the boundaries between private properties bordering the park and the park itself.

The deadline for the conclusion of the investigation is just days away - next Friday is when the officials say they should have clarity about ownership for all 12 projects.

Frenchman Bernard Gaultier, whose 100 million baht villa and property near the Trisara resort is being investigated, went to see Khun Cheewapab on Tuesday, he said.

''Mr Gaultier will be going to the police with his papers to clarify the situation,'' Khun Cheewapab said.

Three rai of about 20 rai connected to the property is in dispute, the director added. It's not known whether the disputed land includes the luxurious villa or is adjacent to it.

Special care is being taken with Trisara because it's an operating resort and there was no desire on the part of investigators to disturb guests, Khun Cheewapab said.

The Pullman is due to open for the coming Phuket high season in November.

soon we can know if in Thailand can be someone that has the power to oblige greedy people to respect the wild life, the nature and can preserve this Iand for the future generation..

gentleman, you all seem to miss a crucial point!! the owners of these properties seem to have valid title and construction permits issued by competent authorities. this is a major difference to the cases in other national parks out of phuket. as long as such have not been revoked (which may require a court order) these people are rightful owners of legally constructed properties. to all our knowledge there has been no evidence whatsoever provided to date that the official documentation underlying these properties has been illegally obtained and/or that the owners knew or should have know that there is something wrong. as long as any wrongdoing has not been proven to a court, these peoples' reputation should not been further damaged by sensationalizing media reports. await the outstanding court orders before you go on judging people without knowing any facts...same as you would do at home.

It's odd how you are prepared to condemn ''sensationalizing media reports'' yet at the same time defend the misappropriation of national parklands, Observer. Surely if these title deeds are false, everyone involved would probably have had some knowledge. The word you seem to be unaware of is ''conspiracy.'' Like you, we look forward to knowing all the facts. Resort owners are just not inclined to maximise their land holdings, build above the 80-metre limit or put private facilities on public beaches. Of course, it has to be the fault of the media.

The problem is actually very simple. Officials get paid to issue land titles they know are actually illegal according to the laws on the books. As they are the authority that oversees this, unless an independent audit is done, there is nobody to police or stop them. We are only hearing about the land attached to national parks but there are buildings going up all around the coast of Phuket that are technically illegal. The real issue is about greed and selfishness. People with influence are putting their own private wealth building ambitions ahead of the country and its future generations. Once land moves from public to private ownership it never returns and the land is then used for the enjoyment of a wealthy minority (in the case of an upmarket resort) rather than for the enjoyment of the general public.
Thailand is still in its era of the robber baron, people who partner up with corrupt political connections to mutually enrich each other. It becomes like a cancer and nothing short of a grass roots movement against corruption will change things. The patronage system in places like Patong is now totally entrenched.
