Sackings, Suspensions: Laguna Row Continues

LAGUNA Phuket resorts have sacked eight union leaders and applied to the courts to lay off 49 more staff who are union committee members, the Governor, Wichai Praisa-Ngob, was told yesterday.

He met a delegation of about 30 people at Provincial Hall in Phuket City to hear the union viewpoint on a dispute that began with a blockade of the resorts in February over pay and bonuses.

Still in his early days in office, Governor Wichai said he had not previously been aware of the dispute and would attempt to discuss it with management at Laguna Phuket.

The eight union leaders were sacked without warning on March 1, the governor was told.

Laguna Phuket did not tell the union officials that their services were about to be terminated, nor did the resort group offer any compensation, he was told.

Kasem Keawsawus, a union committee member, said that the eight union leaders planned to seek reinstatement through the courts.

The first date for the case involving the 49 Laguna union committee members had been set for April 28, the governor was told.

All 49 have been suspended, but are still being paid pending a decision by the courts.

The governor said he he could not intervene in court actions but he would invite Laguna management to meet and talk in the hope of finding a resolution.

Khun Kasem said that in the past, Laguna had sent a vice president to meet with the governor's predecessor, Dr Preecha Ruangjan, rather than more senior managers.

The eight sacked union leaders were named as Tra-karn Khumban, Srawoot No-rat, Saroj Sea-ko, Chainarong Jun Dee Viene, Oat Romin, Mana Phongthanaphanich, Natthawut Ritthito and Sirichai Khootkaew.

The dispute began with a union-led blockade of Laguna Phuket's six resorts in early February after staff were given a two-week pay bonus for 2008 and no pay rises for 2009.

Staff anticipated receiving a four-week bonus, plus a four percent pay rise. Laguna Phuket management had demonstrated its concern about the economic downturn by reducing expansion plans.

Part of the rationale for the bonus-pay reduction, the Laguna Phuket management said, was an attempt to preserve jobs in an unpredictable financial climate for tourism in 2009.

Kicking out Union leaders is only things you do in countries run by dictators !
I know most of the guests they have out there comes from countries where unions are a base in there human rights !
If Laguna not can negotiate there way through, then they should sell out and put there money in the bank !!

Gee Peter, you've really got a grip on reality. Do you not see the long-term objectives of the group...trying to keep staff employed. Read the headlines..tourism is down 50%....how is blockading the resorts doing anything to help the situation...take your head out of the sand.
Take a look at the long term view for jobs..why do you think most of the hotels are working a shortened week ? Trying to keep peoples' jobs.

Yes, people need a reality check!! I worked there and know the facts. KP Ho should have ordered their layoff a long time ago. They are only harming other good employees. Well done KP.

"In any Country,..." for a major, profitable brand to want to sack the senior guys who work for them says it all, I'm afraid,....

Weren't these "blockaders" also heavily involved in the Phuket airport shutdown? Well done Laguna, exposing those troublemakers and their ilk who are rapidly invading every aspect of Phuket life.

Weren't they protesting because KP Ho didn't fullfill is contractual obligations?
Editor: Bonuses are at the discretion of management. So are pay rises. Staff expected the good times to continue. You could perhaps argue that unions were looking at performance in 2008, while management was looking at prospects for 2009.

I worked there too. Well done Laguna, these people do not deserve to work at Laguna. I am not a friend of KP Ho's policies, but this Union People only like to protect non-performing and unethical employees. They are a a kind of tumor in Thai society and Laguna.

umm ... did the workers have contracts which stated a yearly review with a min. % of a raise each year? Same about the bonus in the contract??

Dear "Curious" To answer your questions. If this would be in their contract the resorts would have not right to refuse, but this is not in their employee contract (at least is was not in their contract a few years ago and i am certain its not written in the contract now) The union people there are a kind of "Mafia" (at least they like to be a "Mafia") and like to play silly power games... Ones again, i am so happy to hear that KP Ho finally woke up and address this issue with a firm hand. These people cost Laguna (and Phuket) many millions already....

Peter, perhaps you should not shoot from the hip with such offhand remarks. Thailand has labor laws the the unions neither filled per the law in order to strike nor did the take a course to submit this claim to the labor department in advance. No one here is guilty of illegal activity except those who undertook an illegal strike and also a acted illegally in blocking public roads and conducting an illegal demonstration. Last time we looked this country is a democracy with laws intended to protect both employers and employees, perhaps next time you add more meaningful comments.
