Canadian Jason Hoffman is being asked to pay compensation

Canadian Rider 'Drinking Before Crash'

PHUKET: A Canadian man faces serious charges and substantial compensation payouts over a fatal motorcycle crash that occurred within hours of his arrival on Phuket earlier this month.

Jason Hoffman, 32, recorded an alcohol level of 0.195 after the collision in which Pranee Pitaksaktamrong, 18, was killed instantly, according to police.

Another young woman, Wiyada Rodpradit, 17, suffered severe injuries as did Krisada Hemprom, 21.

Mr Hoffman arrived on Phuket on the evening of April 16 and the crash occurred at 5am the following day, said Lieutenant Kanan Somrak of Tungthong Police Station.

''He and a friend were heading back from Phuket Town to Patong on two motorcycles when they turned into Vichitsongkram Road at the lights in central Kathu district,'' the lieutenant said.

''Mr Hoffman crossed over to the wrong side of the road when taking a curve approaching Wat Kathu and the Tong Yung Su Shrine.

''He collided with the motorcycle carrying the three young people. Khun Pranee was killed on the spot.''

Mr Hoffman was treated at Vachira Phuket Hospital and released after a few days. He has been charged with drink-driving and causing a death. The Phuket Provincial Court has granted bail.

''Negotiations have been taking place about compensation,'' Lieutenant Kanan said.

''Khun Wiyada was seeking 300,000 baht initially and now the agreed figure for her is 150,000 baht. For Khun Krisada, the amount has been reduced from 250,000 baht to 100,000 baht.''

Lieutenant Kanan said he understood those amounts would be paid on May 12 when negotiations would continue over the 1.5 million baht being sought as compensation by Khun Pranee's family.

It is believed Mr Hoffman also has additional costs, including his own treatment and lawyers' fees. His family in Calgary has been endeavoring to raise as much money as possible.

Lieutenant Kanan said he believed Mr Hoffman did not have travel insurance.

We have no knowledge of how he came by the bike. In what way would the people who provided the bike be responsible, another steve?

Another STUPID comment. He can have rent the Bike when he was sober and then drink afterwards.
And Please tell me, how can the company who rent out the Bike be responsible ! ! ! Your thinking is ridicules

Ed, I assume Steve is suggesting bikes should be rented with full insurance to make sure that cover is available in the event of an accident ........

His drinking before riding (if true of course) is his own responsibility.
Renting and riding a bike here is also one's own responsibility. The rental shop is NOT responsible for him having a valid DL, that is his responsibility. He may have had one BTW, I don't know.

All responsibility from whomever he got the bike from was lost when he was found over the alcohol limit don't think insurance will cover it

The person, if indeed responsible and alcohol impaired, is getting off lightly. Had he done this in Canada he would be facing a vehicular homicide criminal charge. DUI is a serious criminal offence in Canada. His home province allows liability litigation and instead of a $10,000 settlement it could be in excess of $1million. The usual group who complain of injustice for foreigners are awfully quiet on this tragedy.

What the liability or consequences would be in any other country except Thailand is totally irrelevant.

The only valid argument here is that compensation and/or criminal consequences should be the same for everyone, regardless of nationality.

Since the compensation asked for death is still 10x more than the average in Thailand, it is far from fair and just.

Just like the value of a persons life should not depend on his nationality, neither should the liability.

Everyone should be equal in front of the law. Making foreigners pay 10x more compensation is hardly the "international standard" many aspire to see Phuket adapt.

According to official statistics, alcohol plays a role in over 70% of motorbike accidents. There is no shortage of similar accidents for the purpose of liability comparison in Thailand.

0.195 he was in no state to walk let alone ride even if had insurance at that level of intoxication your scrubbed period, why do people come to this island and leave there brains at home they must go troppo in the sun or something its a unexplained phenomenon.

The amont of people who seem to think it's ok to drink and drive while hiring a vehicle in phuket is the reason I believe its close to the most dangerous roads in the world.

last time I was in kata it was bike week, after 5-6 hours of hard drinking approx 20 riders hopped on there bikes in the dead of night.

This trend can be seen all through the bar scene.

I'm confused, why isn't the police pressing charges of DUI resulting in death and grave bodily harm? He should be looking at 15-20 years in prison. And that is regardless wether the families press charges or not, the Police/authorities should go ahead and press charges anyway. Am I missing something?
